James M. Buchanan on Inequalities - Dictionary of Arguments

Brocker I 566
Inequality/Contracts/Contract Theory/Buchanan: It is characteristic of Buchanan's theory that natural state dwellers are taken realistically, that is, as individuals with significant inequalities that are stronger or weaker, smarter or dumber than others. And since this inequality of ability and characteristics will make natural distribution necessary to a natural unequal distribution, the state of established law will also not be a state of equal right, but a state of legally defined inequality of possession and freedom.
Brocker I 567
The law transforms only the uneven distribution of natural growth into a legally fixed uneven distribution. That this transformation is taking place at all is due to the fact that those who are worse off in natural distribution also benefit from disarmament and the establishment of law.
>Equilibrium/Buchanan
. Problems: See Law/Buchanan.
